Medicaid waivers (also called “home- and community-based services,” or HCBS) are programs that provide long-term care services to people with disabilities, helping them stay at home or in their communities instead of going to nursing homes or other institutions. These waivers allow people to receive the same care at home that they would normally receive in a facility.

Why Do Medicaid Waivers/HCBS Exist?

People with disabilities have the legal right to live and get services in places where non-disabled and disabled people live and work.This is part of the Americans with Disabilities Act (ADA), which says that services should be provided in the least restrictive way possible. This means that people should not have to move to institutions to get the care they need. States are required by law to provide these services, not as a favor, but because they are legally obligated to do so.
